Terms of Service

These Terms govern your use of PhotoMode (the “Service”). By requesting an account or using the Service you agree to them. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 18 years old. Accounts are subject to manual approval and may be refused, suspended or removed at our discretion. You sign in using a one-time link sent to your email; you are responsible for keeping your email account secure and for all activity under your account. One person per account.

2. Your content

“Content” means photos, captions, character backstories, fan fiction, comments and anything else you submit. You keep ownership of your Content. You grant PhotoMode a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, resize, display and distribute your Content in connection with operating and promoting the Service (including previews on search engines and social media for non-adult content). This licence ends when you delete the Content, except for backups and copies reasonably retained for a limited period.

You confirm that you own or have the right to share your Content, including in-game screenshots, and that it does not infringe anyone's rights. Virtual photographs and fan works are based on games and characters owned by third parties; PhotoMode is not affiliated with or endorsed by any game publisher or developer. Such works are shared as non-commercial fan content.

3. Acceptable use

You must follow our Content Policy. You must not: upload illegal content; harass, threaten or dox others; impersonate others; spam; scrape the Service at scale; attempt to bypass age or content restrictions; upload malware; or interfere with the security or operation of the Service.

4. Mature (NSFW) content

Adult content is permitted only where correctly labelled NSFW and permitted by the Content Policy. NSFW content is hidden from visitors who are not signed in and from members who have not opted in. By enabling mature content you confirm you are at least 18 and that viewing such content is lawful where you live.

5. Moderation

If we suspect a character is not genuinely your original character, we reserve the right to disable fic and backstory locking (and the OC label) at any time. See the Content Policy.

We may remove Content, restrict features, or suspend or terminate accounts at any time, with or without notice, particularly for breaches of these Terms. You can report content using the Report buttons. Decisions of moderators are final, but you may contact us to appeal.

6. Copyright complaints

If you believe Content infringes your copyright, email [email protected] with the URL, proof of ownership and a statement made in good faith. We will review and remove infringing material and may terminate repeat infringers.

7. Termination

You may stop using the Service and delete your Content at any time, or ask us to delete your account. We may suspend or terminate access if you breach these Terms.

8. Disclaimers and liability

The Service is provided “as is” and “as available” without warranties of any kind. To the fullest extent permitted by law, PhotoMode and its operators are not liable for indirect or consequential loss, or for user-submitted Content. Nothing in these Terms limits liability that cannot be limited by law.

9. Changes

We may update these Terms. Continued use after changes means you accept them. Material changes will be announced on the Service.
